
The building rules in municipalities are set to be amended as part of the State government’s ongoing measures to facilitate an investment-friendly environment.
Amendments will be made to the Kerala Municipalities Act, Kerala Municipalities Building Rule, Kerala Municipality (Registration of Tutorial Institutions) Rules 1999 and the Kerala Municipality (Registration of Private hospitals and private Para medical Institutions) rules 1997, Minister for Local Self-Governments M.B. Rajesh said at a press conference here on Thursday.
The building rules will be amended to allow parking on one’s own land within a radius of 200 meters, easing the requirement that all parking be provided on the land where the building is being constructed.
The front- yard requirement has been reduced to one metre for houses of up to 100 square metres built on land up to two cents with a road of up to 3 metres width in front of them.
For houses located at the end of streets of length less than 75 metres, the requirement to maintain a distance of one-and-a-half meters from the street will be relaxed. If such a street leads to not more than five plots or buildings, the distance from the plot boundary adjacent to the street to the building may be reduced to one meter on the basis of a written consent of all the landowners and building owners using that street.
The necessary amendment for this will be made in the second sub-rule of Rule 23 of the Building Rules.
If all the conditions to be followed regarding the building have been met, the permit will not be cancelled merely on the ground that there are discrepancies in the plot area. An exemption will be given under Rule 19(5) of the Building Rules.
Structures covered with sheets in front of houses and open on one side, to protect the house from rain or sunlight, will not be considered as a separate construction. This exemption will be granted subject to conditions.
An amendment in this regard will be made in Rule 23(1), 2 (bf). This exemption will be granted by ensuring that the sheet being installed does not cause any violations such as encroachment on the road. No floor can be constructed in the area under the sheet or used for any purpose not permitted by the rules.
The permit period will be increased to 15 years. Those who have given away land free of cost for road development will be given exemptions by ensuring minimum setback. Proposals have also been prepared to provide exemptions by levying fines subject to conditions for violations of the provisions of Rule 26 for setback, Rule 27 for coverage, Rule 29 for parking, and Rule 28 for access, included in Appendix M.
