
The mother of the deceased Walayar girls had sex with the first accused “in the presence of children” and also “abetted the first accused to commit sexual assault” on her younger daughter by intentionally aiding him after “knowingly fully well that the elder sister of the victim was raped and sexually assaulted by the first accused,” according to the CBI.
The chilling details of the sexual exploitation and suffering endured by the two minor girls for years, which according to the investigation agency, was abetted by their father and mother, emerged in the charge sheet filed before a CBI court here two weeks ago.
The mother entertained the first accused in her house with liquor on holidays when “she had the full knowledge that her elder daughter was raped and sexually assaulted” by the first accused. The couple “willingly neglected the children and caused them to be raped and sexually assaulted and abused” by the first accused, the CBI concluded.
The agency has arraigned the mother and her husband as the second and third accused and Valiya Madhu, her close relative, as the first accused.
According to the CBI, the mother had witnessed the first accused outraging the modesty of her elder daughter in April 2016. Two weeks later, the father witnessed the accused again abusing the child.
Yet, they did not “reveal the incidents of sexual abuse by the first accused on the elder child to the police” and continued to be in regular touch with the accused, according to the charge sheet.
The two girls were found hanging in the house, the 13-year-old girl on January 13, 2017, and the 9-year-old on March 4, the same year.
The mother and the father, according to the CBI, used to send the younger girl to the house of the first accused even after the death of the elder daughter. The younger one, who was close to her sister, knew that she was harassed by the accused, the CBI has reported.
The CBI, which took over the investigation after a trial court had acquitted all the accused in the case, concluded that the two girls were exposed to “rape and sexual assault by the first accused due to the wilful negligence of the mother and father.
The case had created a stir in the State following the acquittal of the accused and the mother launching a public campaign seeking justice for her children. She tonsured her head in protest against the delay in delivering justice to her kids.
She also contested the last Assembly election against Pinarayi Vijayan from the Dharmadom Assembly constituency to seek justice for her children and opted for the election symbol frock, which according to her represented her kids.
The CBI team, which took over the investigation in 2021, has filed six charge sheets in the case.
